Agreement to Terms

By accessing or using the services provided by Desert Springs Digital ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services

Desert Springs Digital provides web development, digital marketing, and branding services. The specific scope, deliverables, and terms for each project will be outlined in a separate agreement or proposal provided to clients.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information necessary for the completion of services
• Respond to communications and provide feedback in a timely manner
• Ensure you have the rights to any content, images, or materials you provide
• Make payments according to the agreed-upon schedule

Intellectual Property

Upon full payment, clients receive ownership of the final deliverables created specifically for their project. Desert Springs Digital retains the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing.

Payment Terms

Payment terms, including amounts, schedules, and methods, will be specified in individual project agreements. Late payments may result in project delays or suspension of services. All fees are non-refundable unless otherwise specified.

Limitation of Liability

Desert Springs Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our services. Our total liability shall not exceed the amount paid by the client for the specific services in question.

Termination

Either party may terminate a project agreement with written notice. In the event of termination, the client shall pay for all work completed up to the termination date. Any deposits or advance payments may be non-refundable depending on the work completed.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any changes.
